ZRP Appeals Decision To Compensate Gogo For Brutal Assault

The Zimbabwe Republic Police has asked the High Court to review the decision made by Harare High Court judge Nicholas Mathonsi who awarded Gogo Lilian Chinyerere (64) $13 500 as damages for shock, pain and suffering.

Gogo Chinyerere was assaulted by armed riot police officers with booted feet and truncheons while sitting near the court entrance at the Harare Magistrates Court in August 2016. When the decision was made the ZRP and the Ministry of Home Affairs, who were represented by lawyers from the Civil Division of the Attorney General’s Office, denied the charges and alleged that Gogo Chinyerere fabricated the charges to tarnish the image of the police.

However, last week ZRP Boss, Commissioner-General Godwin Matanga and Home Affairs and Cultural Heritage Minister Cain Mathema filed an application seeking to have the decision rescinded arguing that when the decision was made, they were not aware. Part of their court papers read,

This is an application for the rescission of default judgements handed down in Harare by honourable justices (Happias) Zhou and (Nicholas) Mathonsi on the 29th of June 2018 and 19th of September respectively. Applicants were in default. Applicants were not aware of the existence of the court case thus they failed to defend or attend the court…

Gogo Chinyerere was awarded $5 000 for damages for pain and suffering, $5 000 being damages for contumelia (indignity), $2 500 being special damages for loss of income and $1 000 as damages for past and future medical expenses.
