Thigh vendor slapped with 140 hours unpaid labour for cell phone theft
A SUSPECTED commercial thigh vendor has been ordered to perform 140 hours of unpaid work at Zimunya Police station for stealing a client’s cell phone, after he failed to pay for her services.
Memory Mutumbi (21) was initially jailed for six months when she appeared at Mutare magistrates’ court recently.
Mutare magistrate Mr Tendai Mahwe set aside two months of her jail term for five years on condition that she does not commit a similar offence within that period.
The remaining four months were also suspended on condition that she performs 140 hours of community service.
Mutumbi was convicted on her own plea.
She was being charged with theft as defined in Section 113 (1) (a) (b) of the Criminal Law Codification and Reform Act Chapter 9:23.
Mutumbi told the court that she only took the cell phone after Ronnie Gonzo failed to pay for her services.
“I took the cell phone after he failed to give me money for my services,” she said.
State counsel, Mr Obert Chifamba had it that on August 5, 2018, at around9pm Mutumbi and Gonzo were drinking beer seated in the latter’s car along Vumba Road.
Gonzo got drunk and Mutumbi took advantage of the latter’s drunken stupor to steal his cell phone before going away unnoticed.
“When the complainant woke up he discovered the offence and immediately reported the theft at Mutare Central police station,” said prosecutor Chifamba.
On August 9, 2018 detectives received information to the effect that Mutumbi was in possession of the cell phone.
Acting on the information detectives made a follow up and proceeded to Mutumbi’s place of residence where a search was conducted leading to the recovery of the cell phone.
Mutumbi was arrested and subsequently taken to court where she was ordered to perform unpaid work.
