Magistrate dissatisfied with Kamambo trial delays
HARARE magistrate, Bianca Makwande, was not amused yesterday after former ZIFA president, Felton Kamambo, attempted to seek a two-week postponement in order to go through a transcribed record of proceedings.
Kamambo is facing bribery charges.
The trial has been ongoing since 2020.
He appeared in court yesterday where the defence case was supposed to get underway but couldn’t because his lawyer Chenaimoyo Gumiro was not available.
He was represented by Nicholas Chikono, who sought a two-week postponement.
“The record of proceedings speaks to the proceedings that occurred in court and Mr Gumiro was here at all times and he heard the evidence that was being led from the witnesses and it’s the issue of the exact words and, maybe, the exhibits that he wants to check,” said Makwande.
“We can’t postpone for over two weeks because he is an officer of the court and he was there. He knows the evidence that was led and if he needs the nitty gritties, which are contained in the docket, it doesn’t require two weeks.
“The interest of justice should be taken into account and two weeks will not be in the interest of justice. The issue of the record is neither here nor there but the issue is he’s aware of the witnesses, and the evidence that was led, he even made an application for discharge at the close of the State case and that application isn’t made without being aware of the proceedings.
Michael Reza, on behalf of the State, reiterated that there was a need to bring the case to finality as it has been going on for too long.
The defence and the State agreed to postpone the matter to May 26 for the defence case.
