I never give up: Wicknell
INTRATREK Zimbabwe managing director, Wicknell Chivayo yesterday said he does not give up in a social media message many took to suggest he is confident of winning the current court case involving Zimbabwe Power Company at Rotten Row.
“The secret to SUCCESS is never ever GIVE UP….If I fall seven times, I stand up EIGHT”
This was in response to developments in court last Friday when ZPC financial director Eubert Chiwara told the magistrate that Chivayo got the tender for the Gwanda solar project on the basis of recommendations by the ZPC evaluation committee and State Procurement Board.
Chiwara testified before Magistrate Lazini Ncube in the ongoing trial where Intratrek and Chivayo are facing charges of defrauding ZPC of over $5,6 million.
Having given evidence earlier on, Chiwara was on Friday under cross-examination by Chivayo’s lawyer, Advocate Lewis Uriri, instructed by Wilson Manase.
Chiwara told the court that Intratrek were one of three companies out of an initial six bidders whose paperwork was in compliance with the law, adding that the ZPC chain manager was however, best-placed to give more details on the evaluation process.
“It is alleged accused was paid without an advance payment guarantee, but for some of the payments made, there was no need for advance payment guarantee because it was not an advance payment. ZPC was paying for work already done not which was to be done,” he said.
Chiwara said Intratrek carried out some of the work at the Gwanda site, the job was not completed. On the other hand, Uriri said the problem lay with ZPC who failed to secure an Environment Impact Assessment certificate from EMA within a 24-month period.
Intratrek argue that the dispute with ZPC is civil and should not be treated as a criminal matter.
Trial resumes on March 28 when a second state witness is expected to testify.
