The trial involving Vice President Constantino Chiwenga’s estranged wife, Marry Mubaiwa failed to kick off as scheduled yesterday as the prosecutor was not available with the docket.
Mubaiwa appeared before Harare regional magistrate Marehwanazvo Cola for assault. Marry is alleged to have assaulted VP Chiwenga’s family domestic worker, Delight Munyoro.
Representing the prosecutor Netsai Mushayabasa, Charles Muchemwa told the court that trial couldn’t kick off because Mubaiwa was still undergoing treatment as the had not fully recovered, adding that Mubaiwa would be avail-able on November 30.
Mubaiwa’s lawyer Beatrice Mtetwa was quick to correct the State’s position saying that although her client was not yet well, they were ready for trial as there was anticipation that it would be dealt with within a week.
“Your Worship, may it be properly placed on record that the reason for postponement is that the trial prosecutor isn’t around, my client hasn’t fully recovered yes, but we had come prepared for trial only to be told that Mushayabasa isn’t around with the docket.
‘We had hoped that trial would commence and be over within a week so that she can resume treatment. She is moving around with a catheter that’s draining stuff from her arm, we hope that trial can kick off on November 30,” she said.
Mubaiwa had a catheter on her swollen arm with a long tube and also had swollen legs.
VP Chiwenga’s family domestic worker, Munyoro filed a report with the police alleg-ing that Mubaiwa had assaulted her at Hellenic School Mowing a heated argument over the custody of Mubaiwa and VP Chiwenga’s three minor children.
Munyoro claims to have sustained a cut on her lips after being struck by Mubaiwa.
She is also daiming that some of her teeth are loose and are now shaking following the alleged assault. On two separate records, Mubaiwa appeared before Harare regional magistrate Ngoni Nduna and the matter was deferred to Novem-ber 3o after the State, represented by Charles Muchemwa, told the court that they were yet to receive the docket from the police to be able to set a trial date. Mubaiwa is also facing six wunts ofextemal-isation involving over USsr million, five counts of money laundering involving over US39oo 000 and a fraud charge in which she forged a marriage with the Vice President, in which chief magistrate Munamato Mutevedzi is set to tes-tify.
Mubaiwa is also facing attempted mur-der charges and is alleged to have unlawfully removed the Vice President’s medical intra venous giving set, as well as the central venous catheter when he was battling for his life at a hospital in South Africa, causing him to bleed profusely.
It is further alleged that she forced him offthe bed, held his hand, and moved him out of the ward before being intercepted by the security personnel she had kicked out of the room prior to her shenanigans.
Mubaiwa was intercepted at the exit where the hospital staff was called by security to connect the medical instruments she had unlawfully removed, resuscitating the Vice President, but she disappeared from the hospital soon after.
The court heard that the complainant, Vice President Chiwenga, prior to his admission in hospital, had been airlifted to South Africa for emergency medical attention on June 22, but upon arrival, his estranged wife had detained him at a top hotel in Pretoria, denying him medical attention; prompting the security team to force their way into the hotel on June 24 and take him to hospital.
Upon his admission, Chiwenga had the two medical instruments inserted and was placed under 24-hour monitoring by the doctors and his security personnel as he was helpless, the court heard.
