Concern over First Street homeless mental woman’s case
A homeless Harare woman who used to occupy a space along First Street is accused of assaulting another woman twice.
Lydia Ndhlovu who has been rotting in remand prison following the alleged assault of her victim, Precious Musengurwa, has been behind bars since early February.
Ndhlovu yesterday appeared before Harare magistrate Yeukai Chigodora where her trial failed to kick off.
Ndhlovu used to occupy a space at the corner of 1st Street and George Silundika where the alleged attack took place separately in May 2020 and February 2021.
She told the court that she is a mental patient and wasn’t in her right state of mind during the two alleged incidences.
The homeless woman has been awaiting a third doctor’s report for her trial to kick off.
On the first count, Ndhlovu, at the corner of 1st Street and George Silundika, assaulted Musengurwa with a pot once on her forehead and back on May 29, 2020.
Resultantly, Musengurwa sustained ‘a deep cut on the forehead’, reads the State papers.
Again this year on February 5, Ndhlovu assaulted Musengurwa after telling her that she had snatched her husband.
Ndhlovu went on to pull Musengurwa’s hair hitting her head five times against a metal dust bin before she fled the scene.
Musengurwa also sustained injuries before logging a complaint against Ndhlovu leading to her arrest.
Magistrate Chigodora noticed that Ndhlovu’s case had taken longer than expected before tasking a prison officer available in court to provide the third outstanding doctor’s report.
At law when a litigant is suspected to be a mental patient, he or she is expected to be examined by two doctors.
Ndhlovu is expected back in court on May 24 when she is expected to have been examined and ready for her trial to kick off.
