A taxi driver from Bulawayo allegedly lost more than $5 000 after he was defrauded by two men who sold him a non-existent residential stand.

Phawulani Ndlovu (37) allegedly paid $5 220 to Promise Moyo (42) and Wilson Banda (56) to purchase the stand that was said to be at Pumula South suburb. A court heard that the duo used fake names with Moyo calling himself Nkosilathi Dube and Banda using the alias Lysias Museba.

The duo is facing a fraud charge. Magistrate Ms Sthembiso Ncube issued a warrant of arrest for the duo after they failed to appear in court on Monday.

Prosecuting, Miss Tafadzwa Mutsambiwa said that Mr Ndlovu met Sethukani Ncube last year and told him that he was looking for a residential stand in a developed area with access to electricity.Miss Mutsambiwa said Ncube acted as an agent and introduced Mr Ndlovu to the duo.

He said Banda was the owner of the stand. “The trio took Mr Ndlovu to Dube and Associates Law firm along Fife Street in Bulawayo where they allegedly produced a fake identity card showing that Wilson Banda was Lysias Museba. An agreement of sale was signed,” she said.

“The agreement was that Mr Ndlovu would pay $6 259 and he allegedly paid $4 000 that same day. On April 12, he allegedly paid $500 and signed an acknowledgment receipt at Dube and Associates law firm. He later paid $629 and $120 to Moyo’s wife after he sent her to collect the money stating he was ill.

“Moyo and a woman went to Pumula Housing office so that she could sign for the change of ownership on behalf of her husband, but was not allowed to sign since she did not appear in the file. After that Mr Ndlovu tried contacting Banda but his mobile number was not reachable.”

The court heard that on July 14 this year, Mr Ndlovu received a call from Pumula Police Station and went there. He met the real Lysias Museba who showed him the proof of ownership of the stand. It was not revealed in court how the duo was arrested.
